Referral to the Environment Court
On 20 March 2008, under Section 150AA of the Resource Management Act, Unison's application and the 130 submissions were provided to the Environment Court.
The Environment Court process began by Unison serving a notice of motion and an affidavit on the Court. Unison is required to serve all submitters with a copy of these documents.
If submitters wish to be heard in support of their submission they had 15 working days, from the date of receipt of the notice of motion and affidavit from Unison, to advise the Environment Court.
Submissions
Submissions closed at 5.00 pm on Friday 7 March 2008.
The Minister for the Environment received a total of 45 submissions on Unison’s Wind Farm Proposal. In addition 85 submissions were received by the Hastings District Council.
The Environment Court will hear and consider the submissions, and will make a decision as to whether or not to grant resource consent for Unison’s Te Waka wind farm proposal.
Background
Unison Networks Limited is proposing to establish a wind farm near the Te Waka Range in Hawke’s Bay. The proposed wind farm would consist of up to 34 wind turbines. You can view a copy of the application on the Hastings District Council’s website.
The Minister for the Environment, Hon Trevor Mallard 'called in' Unison’s resource consent application under the Resource Management Act 1991 and has referred it to the Environment Court.
